Products Liability and Mass Torts

     Products Liability litigation is presently in a state of flux.  Formerly, Standard B.A.J.I. instructions were used which outlined the separate standards for adequate warnings, design defects and manufacturing defects.  Currently, some courts use the Standard Instructions while others use the new instructions based on the Restatement of Torts 3rd Edition in which the standards are merged for adequate warnings and design defects.  This means clients require experienced attorneys who keep abreast of the ongoing developments in this practice area.
